In cases of unfair competition in imports, one of the measures taken to protect a domestic production sector from damage caused by imports subject to dumping or subsidies is the initiation of an anti-dumping investigation. As a result of such investigations, the Ministry of Trade may impose anti-dumping duties or countervailing duties on the imported product under investigation.
Anti-dumping investigations may be initiated either upon a complaint or ex officio. If, after an initial review, there is sufficient evidence that the imported product is subject to dumping or subsidies and that such imports are causing harm, an investigation is formally opened.
If the investigation determines the presence of dumped or subsidized imports and confirms that they are causing injury to the domestic industry, an anti-dumping duty or countervailing duty is imposed by the Ministry. This duty is determined based on the dumping margin or subsidy amount or, if necessary, at a lower rate sufficient to eliminate the damage.
The Ministry's General Directorate of Imports generally completes these investigations within approximately one year. During the investigation, importers of the concerned product in Turkey and foreign firms suspected of engaging in dumping are given the opportunity to defend themselves. The information obtained from the parties is evaluated by the relevant departments of the General Directorate of Imports, and the Ministry issues a decision, which may include temporary or final measures.
